Disclosure of Your Personal Information

Her AI Success ("HAI," "we," "us") may disclose your personal information to a government institution, regulator, or law enforcement authority that has asserted lawful authority to obtain it, or where HAI has reasonable grounds to believe the information could be useful in investigating unlawful activity, or to comply with a subpoena, warrant, court order, or legal obligation under applicable EU or national law. If HAI is involved in a merger, acquisition, or other reorganization, your personal information may be transferred to the resulting entity, subject to equivalent data protection safeguards under GDPR Article 6(1)(f).

You further agree that HAI may share your information with its group companies, service providers, and processors located inside or outside the European Economic Area (EEA), solely for purposes of performing the services you have requested, and always subject to appropriate safeguards (such as Standard Contractual Clauses) where data leaves the EEA. You acknowledge that such affiliates or processors may, from time to time, be required to disclose information in response to valid demands from governments, regulators, courts, or law enforcement in their respective jurisdictions.

Anti-Spam and Electronic Communications

We are committed to complying with the EU ePrivacy Directive, the GDPR, and applicable German law (including the UWG/TTDSG) governing unsolicited electronic communications. All commercial electronic messages ("CEMs") sent by HAI will include:

- Clear sender identification and contact information

- A functioning unsubscribe mechanism in every message

- Prompt processing of opt-out/unsubscribe requests

A descriptive subject line consistent with the message's purpose

If you unsubscribe, HAI will stop sending you electronic marketing communications. Unsubscribe requests submitted via the links in our CEMs will be processed without undue delay, and no later than 10 business days from the request.

Website Terms of Use

The Terms of Use governing your use of the Her AI Success website contain important provisions disclaiming and limiting liability, and determining applicable law and jurisdiction for disputes related to your use of the site. Those provisions apply equally to disputes arising from this Policy and the collection, use, and disclosure of your personal information, and are incorporated by reference as though fully set out here.

Former Users

If you stop using the Her AI Success website or your access is terminated, HAI may continue to use and disclose your personal information in accordance with this Policy as amended, and subject to your rights under GDPR (including erasure, restriction, and objection) and applicable law.

Policy Changes

This Policy may be updated by HAI from time to time at its sole discretion. The version in effect at the time of collection governs the use and disclosure of your personal information. Updated versions will be posted on this page with a revised effective date. Continued use of the website, or continued receipt/request of electronic communications after changes take effect, signifies your acknowledgment of the updated Policy.

Your Rights Under GDPR

Because Her AI Success processes personal data of individuals in the EU, you have the right to access, rectify, erase, restrict, or object to processing of your personal data, and the right to data portability and to lodge a complaint with your local Data Protection Authority. Governing Law and Jurisdiction

This Policy is governed exclusively by, and construed in accordance with, the laws of [Germany / EU Member State of incorporation], except where mandatory consumer-protection or data-protection law of a user's country of residence applies. Each party submits to the exclusive jurisdiction of the competent courts of [City, Germany] for any dispute arising from or relating to this Policy.

Each party waives, and will not assert by way of motion, defense, or otherwise, any claim that:

- Such party is not subject to the jurisdiction of such court

- Such action is brought in an inconvenient forum

- The venue of such action is improper

- Any subject matter of such action may not be enforced by such court

Severance of Terms

If any provision of this Policy is held by a competent authority to be invalid or unenforceable in whole or in part, that provision shall, insofar as it is severable, be deemed omitted from the Policy, and the validity of the remaining provisions shall not be affected.
